3. Payment and Refund Policy

Monthly Services Payment and Terms: For services billed on a monthly basis, such as Social Media Management, Google Advertising or others (labelled as "Applies Monthly Services Payment and Terms" in the service description), clients agree to pay the agreed-upon fee at the beginning of each service month. These services are subject to a minimum commitment as described on the payment page and in any service-specific agreements. Cancellation policies will be clearly outlined in the service description.

Project Services Payment and Terms: Completion dates for project services such as web design, graphic design (labelled as "AppliProject Services Payment and Terms" in the service description) are based on the scope of work agreed upon at the beginning of the project. Digital Marketing Agency, LTD strives to complete projects within the maximum time frame specified in the project/service description, but actual completion dates may vary. Clients will be notified of potential delays as soon as possible. In some cases, project timelines may be extended due to factors such as changes requested by the client, delays in obtaining necessary information or materials from the client, or unforeseen difficulties. Any changes in project timelines will be communicated to the client.

All payments for services provided by Digital Marketing Agency, LTD from this website must be made through Stripe, our authorized payment processor.

Full payment is required before the commencement of any service.

Due to the nature of digital marketing services, we do not offer refunds once work has commenced. If you have any concerns about the services received, please contact us to discuss potential resolutions. Refunds can only be made if Digital Maketing Agency, LTD refuses to perform the service.

4. Changes and Delays

Digital Marketing Agency, LTD is committed to meeting the agreed-upon timelines for all services. However, timelines may be subject to change due to unforeseen circumstances or changes in project scope requested by the client. In the event of a delay, Digital Marketing Agency, LTD will inform the client at the earliest opportunity, providing a revised timeline and working diligently to minimize any inconvenience. For project-based services, clients may request changes to the scope of work, which may affect the completion timeline and costs. Such requests must be made in writing (or in correspondence) and may be subject to additional charges and revised timelines, subject to agreement by both parties.

For project-based services, such as website development and others, the completion timeline is contingent upon timely cooperation and provision of necessary information, assets, and approvals by the client. Digital Marketing Agency, LTD relies on the client to provide all required materials and feedback within 5 days of request to adhere to the estimated project timeline.

In the сase that the client fails to provide the necessary information, assets, or feedback within 10 days of our request, or if the client does not maintain communication for more than 10 days, the project timeline may be adjusted accordingly. Digital Marketing Agency, LTD reserves the right to pause or cancel the service without refunding any advance payments made by the client in these circumstances.

If client inaction or lack of response extends beyond 10 days, Digital Marketing Agency, LTD reserves the right to terminate the project. In such cases, the client shall forfeit any payments made to date, recognizing these as costs incurred by Digital Marketing Agency, LTD in reserving resources and scheduling for the project.

Clients are encouraged to maintain open and timely communication to ensure project milestones are met and any potential issues are addressed promptly. By agreeing to these terms, the client acknowledges their role in facilitating a smooth project completion process and agrees to the consequences of any delays on their part.

The number of revisions is agreed in advance and specified in the service/project description. All additional changes will incur an additional fee

5. Intellectual Property

In the сase that a client's social media account is suspended, banned, or otherwise limited, preventing us from delivering the agreed-upon services, Digital Marketing Agency, LTD will not be held liable for these disruptions. Furthermore, such events will not result in an extension of the service period or a reduction in fees owed for the service month in question.

Clients are responsible for ensuring that their social media accounts remain in good standing and comply with the terms of service of the respective platforms. Digital Marketing Agency, LTD will work with clients to navigate and resolve such issues to the best of our ability, but the resolution and timeline are largely dependent on the policies and responsiveness of the third-party platform.

Digital Marketing Agency, LTD is not responsible for the content provided by clients for use in marketing materials, websites, social media, or any other digital marketing services. The client assures that all content (text, images, logos, and other materials) supplied to Digital Marketing Agency, LTD is their original work or they have obtained all necessary rights and permissions to use it. The client agrees to indemnify and hold Digital Marketing Agency, LTD harmless from any claims, losses, damages, liabilities, penalties, and expenses (including attorneys' fees) arising from the use of any content provided by the client.

Furthermore, Digital Marketing Agency, LTD shall not be held liable for any actions taken by the client on their website or social media platforms that violate the terms of service of those platforms, lead to the suspension or banning of the client's accounts, or infringe upon the rights of third parties.
